Mizrahi Tefahot Leasing car loan?

The company declared that it tried to contact the borrower and that he "preferred not to answer". The documents show two emails in which the borrower asked to repay the loan, a chat with the company's lawyers, and a message the law office itself sent to his mobile number, answered the same day.

Did you take a car loan from Igud Leasing? Today it sits with Mizrahi Tefahot Leasing Ltd., a subsidiary of Bank Mizrahi Tefahot. One case file records what happens when you try to repay such a loan, and it contains a gap that is hard to explain.

In June 2024 Mizrahi Tefahot Leasing asked the Enforcement and Collection Authority to enforce the pledge on the car and appoint a receiver. It asked to do so without the borrower being present and before any warning was served on him. The request came with an affidavit by Yaniv Perlov, a company employee. Section 4 states that company representatives tried to make contact "several times" and that "the debtor preferred not to answer the representatives' approaches".

Section 4 of the Mizrahi Tefahot Leasing affidavit of 10.6.2024: the debtor "preferred not to answer"
Section 4 of the affidavit of 10.6.2024 in pledge file 515509-06-24 (Hebrew original).

Three documents from the same period tell a different story:

  1. On 14 and 17 April 2024 the borrower sent two emails to Mizrahi Tefahot addresses. In the first he asked how to check the loan balance. In the second he wrote: "I want to repay the loan and sell the car myself", and asked for the payoff amount. His mobile number appears in the signature of both emails.
  2. On 2 May 2024 the borrower exchanged WhatsApp messages with the Chen Fisher Gabbay law office, which represents the company. He gave his email address and a copy of his passport and wrote that he was abroad. The office sent him the amount of the debt.
  3. On 10 December 2024 the Chen Fisher Gabbay office contacted the borrower on WhatsApp, at the same mobile number. He replied the same day.

The affidavit was signed 39 days after the exchange with the law office. It was certified before attorney Victor Fisher, the company's counsel. Following the request, attorney Fisher was appointed receiver over the car.

What does Israeli law say about good faith in performing a contract?

Section 39 of the Contracts (General Part) Law, 1973, provides: "An obligation arising from a contract shall be performed in a customary manner and in good faith, and the same applies to the exercise of a right arising from a contract".

The second half of the section is what matters here. The right to enforce a pledge, to accelerate a loan and to ask for a receiver arises from the contract. The section requires that it, too, be exercised in good faith. Section 61(b) of the same law applies its provisions, as far as appropriate, to legal acts that are not contracts.

The question is simple: may a company declare that a borrower does not answer, while it and its lawyers hold his written requests, his email address, his mobile number and an active chat?

The borrower asked to repay. What happened to the request?

The first email was sent on 14 April 2024 to the Mizrahi Tefahot Leasing support address on the bank's domain. The borrower asked how to check the details of the car, the debts and the loan balance.

The second email was sent on 17 April 2024 to an employee at a Mizrahi Tefahot address. The borrower wrote that the loan had been taken at Bank Igud and that after the merger with Mizrahi Tefahot "contact with the borrower was cut off". He added that his branch could not locate the loan and that he was not in Israel. He asked for "the final amount to repay the loan".

According to the borrower, neither email was answered. No such answer was presented in the enforcement files. In the 2 May 2024 chat the borrower told the law office that the bank had told him it had no car loan on record.

"We tried to contact you": what did the company have?

By 10 June 2024, the day the affidavit was signed, the company and its law office held:

  1. Two emails from the borrower, with his mobile number in the signature.
  2. The borrower's email address.
  3. A WhatsApp exchange with the Chen Fisher Gabbay office from 2 May 2024, including a passport copy and notice that the borrower was abroad.
  4. A debt figure that the office itself gave the borrower on 9 May 2024: 153,263.10 shekels, "not final".

The affidavit does not mention the emails or the chat. Instead, section 6 speaks of an "elementary concern" that if the borrower learned of the request he would hide the car. That was the reason given for acting without notice to him.

The file documents show a borrower who reached out on his own, asked for a payoff amount and wrote that he wanted to sell the car himself to repay the loan.

And what happened next?

On 10 December 2024 the Chen Fisher Gabbay office wrote to the borrower on WhatsApp: "we tried to contact you without success", and asked him to call the office. He replied the same day: "I have been abroad since November 2023. What is the matter at your office?".

Six days earlier, on 4 December 2024, a further file against the borrower had been lodged with the Enforcement Authority, a promissory note file. Nothing was said about it in the chat.

On 22 December 2024, 12 days after the chat, the new file recorded that a warning had been served on the borrower in person and that he "refused to sign". The report was filed by Naamneh Salameh, "Naamneh Salameh Legal Deliveries". The service was reported at "Batzra 16", an address that does not exist.

On 21 October 2025 the enforcement registrar found that the borrower had been outside Israel and cancelled all proceedings and restrictions in the file.

Claim against document

  1. Claim: company representatives tried to make contact and the borrower preferred not to answer (affidavit, 10.6.2024). Document: the borrower wrote to the company twice in April 2024 and corresponded with its lawyers in May 2024.
  2. Claim: there is a concern the borrower will hide the car (affidavit, section 6). Document: the borrower wrote that he wanted to sell the car to repay the loan, and asked for a payoff amount.
  3. Claim: "we tried to contact you without success" (Chen Fisher Gabbay office, 10.12.2024). Document: the message was sent to the borrower's mobile and answered the same day.
  4. Claim: the warning was handed to the borrower in Batzra (service report, 22.12.2024). Document: on 21.10.2025 the registrar found the borrower had been outside Israel and cancelled the proceedings.

What this article does not claim

This article does not deal with whether the borrower owes money or how much. In one promissory note proceeding the court held that it found no substantiated denial of the loan debt. The question here is different: how the debt was collected, and what was declared to the authorities about contact with the borrower.

Open questions

  1. Why were the emails of 14 and 17 April 2024, asking for a payoff amount, not answered?
  2. Which phone number were the calls mentioned in the affidavit made to? According to the borrower, the call log attached to the affidavit shows no number.
  3. Why did the affidavit not mention the 2 May 2024 exchange with the law office?
  4. How was personal service reported at an address that does not exist?
